The Right to Bail: The Intent of the Founders

To attempt to reconstruct the general patterns of practice of early America state legal systems with regard to bail in criminal cases. The project is both an exercise in historical inquiry and the development of information with great application to current problems. The method will involve the study of court records from the period 1780-1800.
